Adam Arrested by Vegas PD – Call Flood Needed!

UPDATE (in reverse chronological order):

Tuesday, 9:22am PST – Yesterday afternoon Adam was unexpectedly released from his cage!!!  Thanks so much to everyone for your help keeping pressing on those violating his rights. More soon on our next-steps.

Monday, 10:00am-noon PST – A half dozen of us did outreach about Adam’s situation outside the Las Vegas Regional Justice Center. We were harassed by a few people with badges – video on that soon. I then stopped by the Las Vegas Detention Facility where Adam was being held. I was told that judge had reviewed his charges and planned to “see” Adam (via videoconference) on Tuesday, which meant another night in jail.


Monday, 9:00am PST (written by Ian Freeman) – Adam’s mom and Pete report that Adam was kept in a cold cell with no blanket, was locked to a chair for five hours, and was not allowed to have water. The jailers have threatened more punishment for Adam if “his clan” keeps calling, including revoking his “phone privileges”. Apparently calls out from the jail are $10 each.

Monday, 2:58am PST – Just decided to stand near the Las Vegas Regional Justice Center this morning holding a sign advocating for the release of Adam Mueller. Hopefully the judge who reads his file will happen to walk by. In the least, I’m sure some folks will inquire about Adam’s status and thus learn just how unaccountable those with badges purporting to serve them really are. Sunday, 9:47pm PST – Just spoke with Adam on the phone. He decided against being bailed out tonight due to the cost ($136) and the length (8-9hrs once the process starts) and instead hope to be released tomorrow. Action Items: Call the lockup and ask them to give Adam a blanket: 702.229.4908 & call the judge’s office and tell them to release Adam: 702.382.6878


Sunday, 8:00pm PST – Adam was arrested by the Metro Vegas PD earlier today for “obstructing”. The bail amount is $640 but Adam indicated prior to being transported that he did not want people to bail him out but that if they’re so-inclined they can make calls on his behalf.

He’s being held at the Las Vegas Detention Facility (702.229.4908). I’m told he’ll be there overnight, that a judge will look at his paperwork (without him, or any public present) at noon and that the lockup will have more info around 2pm (PST). Adam may be released on his own recognizance or the DA may drop the charge. Or, if the judge (702.382.6878) tomorrow believes that there was probable cause Adam will be kept in a cage and won’t see him until Tue. or Wed.


OVERVIEW:

Earlier today, after capturing footage for a video about Food Not Bombs Las Vegas, Adam and I stopped by Weedz Alternatives – a store a couple miles north of The Strip that sells synthetic marijuana – as we heard the owner had been getting harassed by folks with badges.

After learning that the owner wasn’t around, we left our contact info and headed back to MARV, which was parked behind the store in a gravel parking lot on the opposite side of the alley. As we always do, before we parked we had looked around for signs indicating that we could not park there. We found none.

Soon after we returned to MARV we saw a Las Vegas Metropolitan police vehicle cruise by. A short time later two officers approached MARV, one on each side, and barked orders for us to produce ID. The following video, captured via Liberty On Tour’s Qik channel, shows a large chunk of the conversation that preceded the arrest (00:21:06):

When we exited MARV the cops asked “How many more people are inside?” I responded, “None, only us two were inside.” Nevertheless, they entered MARV, guns drawn. I loudly stated to them that I was not consenting to their entry into my home. They ignore me. Adam was placed in handcuffs both of our phones were in his possession. They were taken and placed on the dash of a squad car. We were then held outside, surrounded by cops (at the point of greatest police presence there were five squad cars and eight cops) and peppered with questions for a long time (30-60min?). Adam asked for his handcuffs to be removed. They were not. We were told that a nearby building happened to be a federal building and that they were there out of concern for terrorism.

We tried to communicate that there was no victim for our alleged offenses. When we made clear that we were peaceful they noted that maybe we were doing a “dry run.” We debated at length their actions and their reliance on the use of aggressive force. Prior to Adam being transported I was given both our phones back, which is how the footage below was captured. I made sure to get everyone’s info to better be able to hold them accountable.

Before being placed in the squad car Adam made clear at least twice that though he wasn’t going to cooperate with his being transported he would not resist. Sgt. W. Wilson tried to talk him out of it – essentially telling him that such action was childish. Adam remained steadfast (00:03:48).

    Few random thoughts:

    Did at one point they say you giving your name wasn’t good enough because they needed a number? Due to my religious beliefs, I’m wary of those in power harassing people until they get an identifying mark from them.

    Did that officer really say, “You’re not cooperating and you’re becoming a threat?” Since when does non-cooperation with voluntary interactions indicate a threat? Exercising your legal freedoms is a threat?

    As to the question of if you guys handled it well or not, I think it really depends on what you’re trying to accomplish. If you wanted to expose the intimidating, bullying nature of the police, you succeeded. If you wanted to exercise your rights and avoid going to jail, could have probably just followed the “Am I being detained? Am I free to go?” route.

    I do want to thank you guys for putting yourselves at risk by interacting with the police and exposing their true nature while being polite and non-confrontational.

    That address (600 Las Vegas Blvd South) is a “federal building” only in the sense that it’s leased or owned by the General Services Administration and has offices for both U.S. Senators from Nevada (Reid and Ensign), and the U.S. Representative for the 1st Disctrict of Nevada (Shelley Berkley).     Boy did they drop the hammer fast on our Peaceful friends. Looks like the Gang of Guns(GOG) is quite comfortable doing WHATEVER is necessary until they GET an ID (or whatever else).

    Ian Freeman of Free Talk Live Radio has posted, implying, if Adam would have just said “No thanks.” the GOG would have gone away..

    IMO, I think what would have happended next is the GOG would called in More Guns; i.e; SWAT Team Snipers, to Smoke em’ out..

    Scary stuph for a “Free Country.” The time is NOW to Peacefully Push Back.

    Please take the time to make a Phone Call and Support these guys when they need us most.

    It will help Protect our friend Adam as well as help Pete get Adam out of a Cage (again!) ASAP and get this Show back on the Road! :)

    Well, you guys certainly are getting attention. Adam seems hard headed, but he has a good heart and one can’t claim he doesn’t live by his convictions. I’d have been inclined to answer the way PaulO mentioned: am I under arrest? Don’t know that it would help though since it seems like our militarized police have taken it upon themselves to not only be judge, but also have the temerity of speculating on all manner of activities you “might” be up to. Lord help us all when they get the ability to read our minds because we’ll all be in prison for “thought crimes.” It looks like y’all are going to be stuck with a lot of this stuff as you continue–maybe we can establish some kind of defense fund. Just a thought…

    Las Vegas Police to the rest of the world: don’t visit this city or we will abuse you. We are so stupid that even though our city is bankrupt and the residents are under water, we are so intent upon pushing people around that we will drive off the tourism that keeps this city from going under. We are so oblivious to the fact that we need you as consumers more than you need us as tax-eating criminals that we will make fools of ourselves and act like thugs — thus shooting ourselves in the foot in the long run. The poor costumed baby had no choice. He had to assert his authoriTAY! Why if he didn’t, everybody would treat him as if he were just another tax-munching donut eater. Imagine. Then he couldn’t bust someone for some other crime with no victim without them laughing at him. Why if it weren’t for all of these victimless crimes, he’d have to do something useful with himself. Then he got his hippy little ass handed to him and could not cut it, so I will now go after the people who made it and am what I could never be.     As my friend Wes pointed out about people who lick the boot of the thug, this creature called Tax Payer (not!) was probably humiliated in a way as a kid (probably because of his inability to spell). Instead of growing up to right a wrong, he decided it was better to sidle up to the authority and become one of the bullies. It’s like a Stockholm Syndrome situation. The abused becomes the abuser because he cannot face his own shame and deal with it in an adult manner. This is why people identify with the war-thugs overseas as they blow up wedding parties full of innocent civilians.     I live in Las Vegas but am out of the country at this time.

    I will make sure that the Libertarian Party of Nevada knows about this by e-mailing the state chair. This was on Freedom’s Phoenix today or late yesterday and I just opened it.

    I am outraged and embarassed about this obviously, but since you are from out of state I’ll tell you that the State Supreme Court ruled a couple years back that one must show I.D. on request of the police. I wholeheartedly disagree with that ruling and wonder if they have ever heard of the Fourth Amendment.

    I wish the very best for Adam, and I believe you are doing a fine job.

    Hey before you judge and give false reports on what goes on at the CLVDC try working there first. Yep no blankets in a holding cell, common sense there genius. Thats a weapon or a mode for someone to hang themselves, and yes cry about a TB test. You may not work around a bunch of degenrates jobless people, but we do. So shame on us for wanting to know if someone has TB. Do a lil research on TB and you will find It has a tendency to run rampant in the jail/prison systems. We dont tell you guys how to do your jobs(if you call it that). So dont tell us how to do ours……and how old are you that you gotta call you’re mammies???

    The State Supreme Court ruled the opposite in fact. I believe the case you’re referring to is Hiibel vs 6th Judicial District Court of Nevada. The court upheld that one must identify him or herself, but goes on to explain that that means by name only:

    “To hold that a name, which is neutral and non-incriminating information, is somehow an invasion of privacy is untenable.   Such an invasion is minimal at best.   The suspect is not required to provide private details about his background, but merely to state his name to an officer when reasonable suspicion exists.”

    @tuffguy69…one of the things about maintaining credibility during a debate is to remain logically consistent. You open by suggesting that Adam was giving a false report when he said he wasn’t given a blanket at the gulag. In the next sentence you confess, ” Yep no blankets in a holding cell, common sense there genius.”, confirming that Adam statement was telling it exactly like it was at CLVDC. Obviously, the appelation “genius” doesn’t apply to you.

    You write that no blankets are given because they can be used as weapons. I suggest you change your moniker here from tuffguy to girlyman. If you can’t withstand a blow from a blanket you obviously are way out of your league in your present “job”. And God forbid that the inmates ever get hold of a supply of pillows; just think what mayhem could arise from an all-out pillow fight.

    As for the TB tests, they will not, in and of themselves, protect you. By the time you get a positive reaction at the injection site and quarantine and treat the TB you may well have already been exposed.

    Well, I see you agree on one thing here, and that is no one should be telling anyone how to do their jobs. Adam and Pete, in the scope of their jobs, were waiting peacefully in their parked RV trying to decide how best to do their jobs when LVMPD chose to come and tell them how their jobs should be done. I hope that LVMPD will take your advice to heart and next time…mind their own fucking business!

    Tim…you are correct in the Hiibel case. I would point out that the important point to remember is that you have to provide your name, “…when reasonable suspicion exists.” It was held that Hiibel had to at least give his name because officers were contacting him during an investigative stop where someone had reported to the police that Hiibel might have been involved in a domestic violence crime.

    However, where there is no probable cause or reasonable suspicion a person need not identify himself to the police. I would argue that the cops here had no reasonable suspicion to approach Adam and question him; therefore, Adam had no obligation to identify himself to them. However, Adam did identify himself by name to them and gave an account as to why he was where he was. Adam went farther than he was required by law, and that should have satisfied the cop’s curiosity.

    i wasnt implying a blanket fight, jus the fact you can be strangled from behind with one but the major concern is suicide. Majority of suicides in jail occur within 48 hours of the intake process, and I do think this whole situation could have been avoided by just offering up ID when asked in a reasonable manner. Good luck in your “Cause”.

    The video shows that Adam did identify himself and he also accounted for his presence in the parking lot. The cops should have left it at that. Adam and Pete were willing to leave the parking lot, but the cops were determined to make this about a show of force and absolute submission, beyond what was required of Adam.

    Adam was reasonable and cooperative. The cops were unreasonable and overreacted. That is what the evidence clearly shows.

    The main problem that is growing seems to be that Police officers, although equipped with sufficient equipment to defend themselves, assume the worst in situations and their assumptions control their actions. You have to respect the officer who can evaluate a situation and act accordingly. Most officers that operate by assuming the worst for every situation are many times a bigger danger than the situation itself. They start assuming and decide to act on that assumption and end up producing or escalating a situation that needed no attention or interference by them and in turn causes a situation with that interference.

    It’s no wonder that jail overcrowding is a nation wide problem. Half the people in jail now were probably jailed due to an arrest that began with an officers assumption of what that person was about to do instead of the officer actually seeing them do it. If you go to the store with a sinus headache and a dead remote control and buy sinus medicine and batteries for the remote you can be arrested for making drugs. WTF is that? Not a symbol of a free society that’s for sure. Police stop you for no tag light and want to search your vehicle. If you say not without a warrant then in retaliation they call for a drug dog to come out just to overrule your basic right to refuse a search. If the dog doesn’t alert then that is a lot of time wasted and energy used by the dept. that was not necessary. That persons time was wasted and paid a price through roadside humiliation with no compensation for it. All that was caused by the officers futile attempt to make an arrest and then they wonder why no one respects them any more.

    Right on, Will Digg!! Law enforcement in Las Vegas is completely out of control. They are nothing but uniformed bullies on a power trip. The worst of the worst, though, are the officers from the Dept. of Parole and Probation — these guys are really wackos! I guess they didn’t have what it takes to become a real police officer. The ones to really watch out for are the ones (quite a few, in fact) who are about 5 feet tall – they have classic “short man syndrome” — these guys are incredibly sadistic and will go to any lengths to destroy the lives of probationers or parolees just so can feel like a “big guy”. These men are extremely dangerous. They are allowed to lie in court about anything they want to without any evidence whatsoever to back up their lies! They can also enter the home where a probationer lives and terrorize his mother for hours for no reason.

    As for the person who calls himself “tax payer” – you must be a little shorty probation officer.
